한국어 · 1. 계약 당사자와 적용

이 약관은 댕댕캐치(PawCatch) 앱 및 앱에서 제공되는 콘텐츠·기능의 사용권에 관하여 운영자 캐치캐치(최동연)와 이용자 사이에 체결됩니다. Apple은 계약 당사자가 아니며, 앱과 콘텐츠에 대한 책임은 운영자에게 있습니다. Apple 플랫폼의 사용 규칙과 상충하는 이용을 허용하지 않습니다.

App Store 배포 앱에 이 문서를 사용자 지정 EULA로 등록하여 적용하는 경우 이용자가 해당 EULA를 수락함으로써 적용됩니다. 홈페이지 게시 자체가 기존 이용자의 재동의나 App Store Connect 등록을 대신하지 않습니다.

2. 앱 사용권

앱은 판매가 아닌 사용권의 형태로 제공됩니다. 이용자는 자신이 소유하거나 관리하는 Apple 기기에서 Apple Media Services 이용약관의 사용 규칙에 따라 앱을 사용할 수 있는 양도 불가능한 사용권을 받습니다. 해당 규칙이 허용하는 가족 공유 및 대량 구매에 연결된 다른 계정의 이용은 허용됩니다. 이는 모든 구독·아이템의 가족 공유 제공을 보장하지 않으며 상품별 안내와 플랫폼 설정에 따릅니다.

법령이나 오픈소스 라이선스에서 허용하는 경우를 제외하고 앱의 무단 복제·재배포·재판매·재사용권 부여 및 소스코드 추출을 위한 역공학을 해서는 안 됩니다. 이용자가 등록한 콘텐츠의 권리는 기존 서비스 약관에 따릅니다.

3. 유지보수와 지원

앱의 유지보수·고객지원 및 법령상 필요한 지원은 운영자가 담당합니다. Apple에는 앱의 유지보수나 고객지원을 제공할 의무가 없습니다. 문의처는 제8항에 안내합니다.

4. 보증과 환불

적용 법률에 따라 유효하게 배제되지 않은 앱의 모든 명시적·묵시적 보증은 운영자가 책임집니다. 앱이 적용되는 보증을 충족하지 못하면 이용자는 Apple에 이를 알릴 수 있으며 Apple은 앱 구매가격을 환불합니다. 법률이 허용하는 최대 범위에서 Apple에는 그 밖의 보증 의무가 없고, 보증 미충족에서 발생하는 나머지 청구·손실·책임·손해·비용은 운영자의 책임입니다. 무료 앱의 구매가격 환불과 구독·인앱 구매 환불은 구분하며 구독 환불은 제11항에 따릅니다.

5. 제품 관련 청구와 이용자 권리

앱 또는 앱의 보유·이용에 관한 이용자나 제3자의 청구는 Apple이 아니라 운영자가 처리합니다. 여기에는 제조물 책임, 법률·규제 미준수, 소비자 보호·개인정보 보호 관련 청구와 적용되는 HealthKit·HomeKit 사용 관련 청구가 포함됩니다. 이용자에 대한 책임을 법률이 허용하는 범위를 넘어 제한하지 않습니다.

6. 지식재산권 청구

앱 또는 이용자의 앱 보유·이용이 제3자의 지식재산권을 침해한다는 청구가 있는 경우 조사·방어·합의 및 해결은 Apple이 아니라 운영자가 담당합니다.

7. 법률 준수

이용자는 미국 정부의 금수 대상 국가 또는 테러 지원국으로 지정된 국가에 있지 않으며, 미국 정부의 거래 금지·제한 대상자 명단에 포함되지 않았음을 진술하고 보증합니다. 적용되는 수출 통제 및 이용 지역의 법률을 준수해야 합니다.

9. 제3자 서비스 조건

앱 이용 시 통신사, 앱마켓 및 연결된 외부 서비스에 적용되는 제3자 이용 조건을 준수해야 합니다. 외부 서비스 조건이 이용자의 법정 권리를 배제하는 근거가 되지는 않습니다.

10. Apple의 제3자 수익자 지위

Apple과 Apple의 자회사는 이 EULA의 제3자 수익자입니다. 이용자가 이 EULA를 수락하면 Apple은 제3자 수익자로서 이용자에 대해 이 EULA를 집행할 권리를 가지며 그 권리를 수락한 것으로 간주됩니다.

11. PawCatch Plus 자동 갱신 구독

제공되는 상품은 PawCatch Plus Monthly(1개월)와 PawCatch Plus Annual(1년)입니다. 실제 제공 여부, 기능, 현지 통화 가격 및 적용되는 체험·할인 조건은 앱과 App Store의 구매 확인 화면에서 확인합니다.

결제가 확인되면 Apple 계정에 청구됩니다. 현재 구독기간 종료 최소 24시간 전에 갱신을 취소하지 않으면 자동 갱신되며, 다음 기간의 요금은 현재 기간 종료 전 24시간 이내에 청구됩니다. 가격 변경은 적용 법령과 Apple의 안내·동의 절차에 따릅니다.

구독 변경·취소는 iPhone의 설정 > Apple 계정 > 구독에서 관리할 수 있습니다. 앱 삭제나 댕댕캐치 회원 탈퇴만으로 App Store 구독이 취소되지는 않습니다. 취소하면 원칙적으로 이미 결제한 기간이 끝날 때까지 이용할 수 있으며, 체험 상품의 종료 조건은 구매 화면 안내를 확인해 주세요. 체험 기간이 제공되는 상품은 체험 종료 최소 24시간 전에 취소해야 갱신 요금 청구를 피할 수 있습니다.

청약철회·환불 등 법령이 보장하는 권리는 유지됩니다. Apple 결제 환불은 reportaproblem.apple.com에서 신청할 수 있으며 앱이나 이용권 오류는 운영자에게 문의할 수 있습니다.

12. 서비스·개인정보·위치정보와 종료

앱의 서비스 이용, 계정·콘텐츠 관리 및 위치정보 처리는 아래 별도 정책에서 안내합니다. 이 EULA 수락은 실시간 위치 공개, 광고 또는 그 밖의 선택적 개인정보 처리에 대한 동의를 대신하지 않습니다. EULA는 앱 사용권과 Apple 관련 조건에 적용하며, 법령상 보장되는 소비자 권리와 개인정보·개인위치정보에 관한 권리를 제한하지 않습니다.

이용자는 앱 이용을 중단하고 삭제할 수 있습니다. 위반에 대한 사용 제한·계약 종료는 서비스 이용약관과 적용 법령의 통지·이의 제기 절차에 따릅니다. 종료 후에도 이미 발생한 법정 권리·의무는 유지되며 App Store 구독 취소는 제11항에 따라 별도로 처리해야 합니다. 문서 변경은 서비스 이용약관의 변경 안내 절차를 따르며 법령상 필요한 동의를 별도로 받습니다.

English · 1. Parties and application

This End User License Agreement (EULA) concerns the license to the PawCatch app, including its content and features, between you and CatchCatch (Dongyeon Choi), the developer. Apple is not a contracting party. The developer is responsible for the app and its content. This agreement does not authorize use conflicting with the Apple Media Services usage rules.

For App Store distribution, this document applies when designated as the app’s custom EULA and accepted by you. Website publication alone does not register it in App Store Connect or obtain renewed acceptance from existing users.

2. App license

The app is licensed rather than sold. Your license is nontransferable and permits use on Apple devices you own or control under the Apple Media Services usage rules, including access by other accounts associated with the purchaser through Family Sharing or volume purchasing where those rules permit. This does not promise that every subscription or item supports Family Sharing; each product’s information and platform settings apply.

Unauthorized copying, redistribution, resale, sublicensing, and reverse engineering to extract source code are prohibited except where applicable law or an open-source license permits them. Your rights in user-submitted content are addressed in the service terms.

3. Maintenance and support

Maintenance, customer support, and support required by law are the developer’s responsibility. Apple has no duty to provide app maintenance or support. Contact information is in section 8.

4. Warranties and refunds

The developer is responsible for all express or implied app warranties except those validly excluded under applicable law. If the app fails an applicable warranty, you may notify Apple for a refund of the app purchase price. To the extent law permits, Apple has no further warranty duty; remaining warranty-related claims, losses, liabilities, damages, and expenses are the developer’s responsibility. Refunding a free app’s purchase price differs from refunding subscriptions or in-app purchases, addressed in section 11.

5. Product claims and statutory rights

The developer, not Apple, handles your and third parties’ claims concerning the app or its possession or use, including product liability, regulatory compliance, consumer protection, privacy, and applicable HealthKit or HomeKit claims. Liability to you is not restricted beyond what law allows.

6. Intellectual property claims

The developer, not Apple, handles investigation, defense, settlement, and resolution of third-party allegations that the app or your possession or use infringes intellectual property rights.

7. Legal compliance

You represent and warrant that you are not in a country under a US government embargo or designated a terrorist-supporting country, and are not on a US government prohibited or restricted party list. Applicable export controls and local laws must be observed.

9. Third-party terms

Observe applicable carrier, app marketplace, and connected service terms when using the app. Third-party terms do not remove your statutory rights.

10. Apple as beneficiary

Apple and its subsidiaries are third-party beneficiaries of this EULA. Your acceptance gives Apple the right to enforce it against you in that capacity, and Apple is considered to have accepted that right.

11. PawCatch Plus auto-renewable subscriptions

Products are PawCatch Plus Monthly (one month) and PawCatch Plus Annual (one year). Availability, features, local prices, and applicable trial or promotional conditions are displayed in the app and App Store purchase confirmation.

Payment is charged to your Apple Account upon purchase confirmation. Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. Renewal charges are made within the 24 hours before that period ends. Price changes follow applicable law and Apple’s notice and consent processes.

Manage or cancel in iPhone Settings > Apple Account > Subscriptions. Deleting the app or your PawCatch account does not cancel an App Store subscription. Cancellation normally leaves access until the paid period ends; trial expiration conditions are shown at purchase. Where a trial is offered, cancel at least 24 hours before it ends to avoid renewal charges.

Statutory withdrawal and refund rights are preserved. Request Apple payment refunds at reportaproblem.apple.com; contact the developer about app or access problems.

12. Service, privacy, location and termination

Separate policies below address services, accounts, content, and location data. EULA acceptance does not replace consent for live location sharing, advertising, or other optional personal data processing. This EULA governs the app license and Apple-specific conditions without reducing statutory consumer, privacy, or location rights.

You may stop using and delete the app. Restrictions or termination for violations follow the notice and appeal procedures in the service terms and applicable law. Accrued statutory rights and duties survive termination. Cancel App Store subscriptions separately as described in section 11. Amendments follow the service terms’ notice procedure, with separate consent where legally required.
